The International Court of Justice Announces Cuba's Intervention in the Genocide Case Against Israel
New York – The International Court of Justice (ICJ) announced last night that Cuba has submitted a declaration of intervention, based on Article 63 of the Court's Statute, in the case concerning the application of the Convention on the Prevention and Punishment of the Crime of Genocide in Gaza, known as (South Africa v. Under Article 63 of the ICJ Statute, when the interpretation of a convention involves states other than the parties to the case, any such state has the right to intervene in the proceedings. In such cases, the interpretation provided by the Court's judgment is binding on all parties equally.

The Court explained that "in exercising its right to intervene under Article 63, Cuba relies on its status as a party to the Convention on the Prevention and Punishment of the Crime of Genocide, dated December 9, 1948." The Court added that, in its declaration, Cuba will present its interpretation of Articles I, II, III, IV, V, VI, VIII, and IX of the Convention.

Pursuant to Article 83 of the ICJ's Rules, South Africa and Israel have been invited to submit written observations regarding Cuba's declaration of intervention.

On December 29, 2023, South Africa filed a lawsuit against Israel, accusing it of genocide. Several countries, including Nicaragua, Colombia, Libya, Mexico, Palestine, Spain, Turkey, and Ireland, have joined the case.
