GAZA – On Wednesday, Al-Ghad obtained the full text of Hamas’ response to the truce deal offered to them.
The agreement aims to halt mutual military operations between Israel and Hamas, achieve complete and sustainable calm, exchange prisoners between the two sides, end the siege on Gaza, facilitate reconstruction, allow the return of residents and displaced individuals to their homes, and provide shelter and relief for all residents in all areas of the Gaza Strip.
The following are the outlined stages and conditions of the ceasefire agreement:
Phase one (45 days):
- A temporary cessation of military operations, aerial reconnaissance, and the relocation of Israeli Occupation Forces (IOF) away from populated areas in the entire Gaza Strip. This positioning will be alongside the demarcation line, enabling the parties to continue the exchange of detainees and prisoners.
- The release Israeli captives, including women and children (under 19 years old and not conscripted), the elderly, and the sick, in exchange for a specified number of Palestinian prisoners. This process ensures the release of all individuals listed in the previously agreed-upon lists during this phase.
- Intensification of daily entry of necessary and sufficient quantities of humanitarian aid, fuel, and similar supplies to meet the needs of the population (to be determined). Adequate amounts of humanitarian aid will also reach all areas in the Gaza Strip, including the northern region, facilitating the return of displaced individuals to their homes.
- Reconstruction of hospitals and establishing camps for residents. This phase involves rebuilding hospitals across the entire Gaza Strip and providing the necessary resources for establishing camps or shelters for residents. Humanitarian services provided by the UN and its agencies will resume.
- Commencement of indirect talks. Discussions will begin regarding the requirements necessary for achieving complete calm.
The attached appendix detailing the first phase is an integral part of this agreement. Further agreements regarding the second and third phases will be made during the execution of the first phase.
The indirect talks regarding the requirements for maintaining the mutual cessation of military operations and returning to a state of complete calm must occur before implementing the second phase.
Phase two (45 days):
- The release all male detainees, both civilians and draftees, in exchange for a specified number of Palestinian prisoners.
- Humanitarian procedures from the first phase will continue.
- The IOF will withdraw from all areas within the Gaza Strip.
- Comprehensive reconstruction efforts will begin for homes, facilities, and infrastructure destroyed across the entire Gaza Strip.
- Specific mechanisms will ensure the implementation of these actions and the complete lifting of the blockade on Gaza, as agreed upon during the first phase.
Phase three (45 days):
- Exchange bodies and the remains of the deceased between both sides after identification.
- Humanitarian procedures from the first and second phases will continue, based on agreements reached during those stages.
Appendix to the framework agreement: Details of phase one:
1. Complete cessation of military operations:
o Both sides commit to a full cessation of military operations, including aerial reconnaissance, throughout this phase.
o The IOF will be relocated away from populated areas in the entire Gaza Strip, aligning with the demarcation line to facilitate the exchange of detainees and prisoners.
o The release of Israeli captives, including women and children (under 19 years old and not conscripted), the elderly, and the sick, will occur. In return, all Palestinian prisoners in Israeli custody, including women, children, seniors (above 50 years old), and the sick, will be released. This includes 500 Palestinian prisoners designated by Hamas sentenced to life in prison or with high sentences, in addition to 1,500 other Palestinian prisoners.
o Legal procedures will ensure that Palestinian and Arab detainees are not re-arrested on the same charges.
o Simultaneous and mutual releases will guarantee the freedom of all individuals listed in the previously agreed-upon lists. Names and lists will be exchanged before implementation.
o Improvements in the conditions of prisoners in Israeli prisons, lifting measures, and penalties imposed after October 7, 2023.
o Halt of Israeli settlers’ incursions and aggression at Al-Aqsa Mosque, restoring the situation to pre-2002 conditions.
o Intensification of daily entry of necessary and sufficient quantities of humanitarian aid, fuel, and similar supplies (not less than 500 trucks) to meet the needs of the population. Adequate humanitarian aid will also reach all areas in the Gaza Strip, especially the northern region.
o Return of displaced individuals to their homes in all areas of the Gaza Strip, ensuring freedom of movement for residents using all means of transportation, unimpeded across the entire Gaza Strip, particularly from south to north.
o Opening of all crossings with the Gaza Strip, resumption of trade, and free movement of individuals and goods without hindrance.
o Removal of any Israeli restrictions on the movement of travelers, patients, and wounded individuals through the Rafah Border Crossing.
o Ensuring the departure of all wounded individuals (men, women, and children) for treatment abroad without restrictions.
o Egypt and Qatar will lead efforts, coordinating with relevant parties to ensure implementation and supervision.
2. Provision and entry of heavy equipment:
o Sufficient heavy equipment necessary for debris and rubble removal will be provided and brought in.
3. Civil defense equipment and health ministry requirements:
o Civil defense equipment and health ministry necessities will be supplied.
4. Hospital reconstruction and shelter establishment:
o Hospitals and bakeries across the entire Gaza Strip will undergo reconstruction. Necessary resources will be provided for establishing camps or shelters for residents.
5. Temporary housing units:
o At least 60,000 temporary housing units (caravans/containers) will be introduced. Starting with the implementation of this phase, 15,000 units will enter Gaza each week. Additionally, 200,000 shelter tents will be provided at a rate of 50,000 tents per week to accommodate those whose homes were destroyed during the war.
6. Infrastructure rehabilitation:
o Infrastructure repair and rehabilitation will commence in all areas of the Gaza Strip. This includes restoring electricity, communication, and water networks.
7. Reconstruction plan:
o A comprehensive plan for rebuilding homes, economic facilities, and public infrastructure destroyed during the conflict will be approved. The reconstruction process will be scheduled within a maximum period of 3 years.
8. Humanitarian services resumption:
o All humanitarian services provided by the UN, its agencies, and especially UNRWA will resume in all areas of the Gaza Strip as they were before October 7, 2023.
9. Fuel supply and electricity:
o Gaza will receive the necessary fuel for re-establishing the power generation station and meeting all sector requirements.
10. Crossings and movement:
o All crossings with Gaza will be opened, trade will resume, and unrestricted movement of individuals and goods will be allowed.
o Israel commits to supplying Gaza with its electricity and water needs.
11. Indirect talks for continued calm:
o Indirect talks will begin regarding the requirements necessary for maintaining the mutual cessation of military operations and returning to a state of complete calm.
12. Exchange processes linked to commitments:
o The exchange process is closely linked to the fulfillment of commitments related to sufficient aid, relief, and shelter as mentioned and agreed upon.
