A joint statement by Morris Tidball-Binz, the UN Special
Rapporteur on extrajudicial, summary, or arbitrary executions, and Alice Gill
Edwards, the Special Rapporteur on torture, emphasized the necessity for
“swift, transparent, and independent” investigations, Amad reported.
The statement underscored that “Independent investigators
must be provided with the necessary resources, support, and required access to
conduct prompt, comprehensive, and impartial investigations into the alleged
crimes committed by all parties to the conflict.”
According to the experts, “The duty to investigate war
crimes and crimes against humanity, including any act of killing without due
process or outside the scope of the judiciary, torture, or other attacks on
human dignity, is a fundamental legal obligation.”
The statement urged the international community to ensure
that all individuals responsible for the most serious violations, especially
those in leadership roles, are swiftly brought to justice.
It emphasized that there is “no statute of limitations” for
war crimes and crimes against humanity falling under the jurisdiction of the
International Criminal Court. This means that courts in any country worldwide
can prosecute those responsible, regardless of their nationality or the country
where these crimes were committed.
According to the experts, they encourage all countries to
take a proactive role in identifying the main suspected perpetrators and
assisting in facilitating legal proceedings through the principle of mutual
legal assistance.
